Job Order Contracting (On-call Contractors)

New legislation and budgets allow local jurisdictions and municipalities to publish and hire contractors (and their architect) through a Job Order Contracting (JOC). Job Order Contracting agreements vary within location and contracting awards are estimated at $20-25 million annually. Nevada and Arizona currently have solicitations published for Job Order Contracting agreements.
Job Order Contracting allows multiple general contractors to be hired during a contract period for on-call work. Types of work may consist of maintenance, repair, alterations, demolition, renovation, remediation or minor construction of public work. Park renovations, play, surface, shade, plumbing, mechanical systems, generator, plumbing and tenant improvement work.
Clark County- Nevada Job Order Contracting
Clark County’s commissioner, Marilyn Kirkpatrick, is leading the way for Clark County to award 5, $5,000.000.00 contracts for local build and design-build projects. Chairman Kirkpatrick’s goal is “to make County government work for citizens and improve the communities that we call home.” In the next 12 months, over 40 projects are projected totaling $25,000,000.00 for the Department for Real Property Management (RPM). The $25 million is just a fraction of the $500 million annual book. RPM leadership shared the intent is to simplify the bid process and get projects completed faster for constituents. Clark County Real Property management and Purchasing Divisions have held workshops to introduce the solicitation that will be published mid-December 2021 with a response date of early January 2022. Contract Award is expected March 2022.
The process of issuing a JOC allows the County and RPM to qualify contractors once for the design and build process, rather than qualifying them for each project. Park renovations, play, surface, shade, plumbing, mechanical systems, generator, plumbing and tenant improvement work are all anticipated work types. Las Vegas, Moapa, Laughlin, Logandale, Indian Springs are on the list of sample potential project locations for Job Order contracting.
Job Order Contracting- Unit Pricing
Clark County has contracted Gordian to help develop the JOC program. There will be universal pricing provided by Gordian. Job order Contracting Unit Pricing will be set through a Construction Task Catalog. (CTC). Gordian will customize the technical specifications. “JOC contracts establish Unit Prices up front. Each Unit Price is calculated using localized labor, material and equipment costs, meaning no more hidden charges and surprise costs. Contractors bid an adjustment factor to the catalog of tasks with preset Unit Prices, called the Construction Task Catalog® (CTC). Once a contract is awarded, the contractor can perform a variety of projects, always using the preset prices in the CTC.”
Senate Bill 67
Senate Bill 67 (SB67) proposed a piolet program in Southern Nevada temporarily authorizing job order contracting delivery method. The goal is to get work out quicker for the construction sector. Agencies authorized include Clark County, Las Vegas, North Las Vegas, Henderson and Clark County Water Reclamation. The piolet is set to end June 30, 2025. SB76 authorizes 2-year fixed term, with one possible extension. The contractor can only self-perform 50% of the work and must sub out the rest accordingly. This opens up the number of opportunities for small business, local business and emerging small businesses to participate.
Arizona Job Order Contracting
Arizona currently has a solicitation out for an administrator of it’s JOC program. Arizona Department of Administration Solicitation No. BPM003959 Job Order Contracting System Administrator is currently posted. The state has identified the basic approach to meeting its requirements, allowing Offerors to be creative and propose their best solution to meeting these requirements. Specific Requirements included in the contract will be revised as necessary as mutually agreed to reflect the awarded successful offeror.
The Contract is an indefinite delivery, indefinite quantity (ID/IQ) type of contract; it is to be construed as a “delivery order” sub‑type of ID/IQ contract to the extent the Work is Materials, and a “task order” sub-type to the extent the Work is Services.
